Additional Information
Minimum rental is 3 days.  Rental begins when unit is received by customer.  Units must be shipped via FED EX with tracking and adult signature required.  Credit card authorization (deposit) for $2500 is required.
Customer will be responsible for all costs of repair if unit is damaged.  In the event that the equipment experiences a breadown due to defects in materials or workmanship, customer is required to notify Company immediately. 
Client is solely responsible for the safe and prudent operation of the Equipment. Client agrees to abide by all federal, state and local laws and regulations while operating the Equipment. MACHINE RELIABILITY shall not be responsible for any claims, losses and/or damages related to Client’s breach of these obligations, or any others, and Client hereby agrees to indemnify and hold MACHINE RELIABILITY A CM SOLUTIONS, INC. harmless against for any such claims, losses and/or damages.                CALIBRATION: Client is solely responsible for ensuring the proper functionality of the Equipment prior to and during Client’s use of the Equipment, including without limitation, by performing a quick calibration check using the traceable calibration standard(s) provided by MACHINE RELIABILITY for each testing mode offered on the Equipment. Please see the Equipment User’s Guide for more information.
In the event that the Equipment experiences a breakdown due to defects in materials or workmanship,customer is required to notify Company immediately.  Company may, at its sole discretion, extend the Rental Period with no additional Rent charged to the Client. Client will be responsible for costs associated with any breakage due to misuse, mishandling, or improper use of equipment. Company may provide similar equipment in good working order, but cannot guarantee the same model will be provided.
[LIABILITY AND INDEMNITY]  MACHINE RELIABILITY SHALL NOT BE OBLIGATED TO BEAR ANY COST OF CLIENT’S LABOR, STANDBY TIME OR TRANSPORTATION CHARGES OR ANY OTHER COSTS RELATED TO THE DELAY OF CLIENT’S PROJECT AS A RESULT OF EQUIPMENT BREAKDOWNS OR IN CONNECTION WITH THE TIME TO REPAIR OR REPLACE DEFECTIVE PARTS.     EXCEPT AS EXPRESSLY STATED HEREIN,MACHINE RELIABILITY HAS NOT MADE ANY OTHER REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, WHATSOEVER, INCLUDING WITHOUT LIMITATION, NON-INFRINGEMENT, THE DESIGN, QUALITY, CAPACITY OR CONDITION OF THE PRODUCT, ITS MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE.
Client is solely responsible for all loss, theft, destruction of or damages to the Equipment in excess of normal wear during the Rental Period. In the event of loss or damage to the Equipment, Client shall promptly notify MACHINE RELIABILITY and shall, at Company’s option;
(1)reimburse Company for the restoration of such damages in order to return the Equipment to pre-rental condition, or (2) replace the Equipment with lien free equipment of the same model, type and configuration in which case the relevant Rental Agreement shall continue in full force and effect and clear title in such equipment shall automatically vest in MACHINE RELIABILITY or (3) pay Company the present value of remaining Rent plus the buyout purchase option price provided for in the applicable Rental Order, if any. It is the responsibility of Client to perform routine maintenance on the Equipment. No loss or damage shall relieve Client of the obligation to pay Rent or any other obligation under the Agreement.        
Client agrees to indemnify, hold harmless and defend Company,  its officers, members, shareholders, directors, employees and agents against any and all losses, damages, liability, claims, demands, judgments and the costs and expenses incident thereto, which Company may incur, become responsible for, or pay out as a result of death, bodily injury, personal injury or destruction of or damage to any property, including any damage to or adverse effect on the environment, arising from or relating to Client’s or Client’s subcontractor’s, agent’s, officer’s or employee’s use, operation, possession, ownership (for strict tort liability only), control, renting, maintenance, delivery or return of the rental Equipment, which includes without implied limitation, misreading test results and/or failing to properly calibrate the Equipment.  
LIMITATION OF LIABILITY CLIENT AGREES THAT MACHINE RELIABILITY SHALL NOT BE LIABLE FOR SPECIFIC PERFORMANCE OR ANY LIABILITY, LOSS, DAMAG
